Subject: Question about 3 times identical position = draw
3 times an identical position is a draw, but only if the same player has
to move, right? At least that's what I have learned.

I was playing an online game when the system tells me: "1/2 3 identical
postions", and the game was ended.

*BUT* this 3rd time it was my opponent's turn, instead of mine like in
the previous two same positions. Which was exactly my plan.

FWIW:
This was the final position, I had black and Kf6 was the last move:
White: Ke4, g5, h5
Black: Ke6, d4, e5, h7

http://www.fide.com/official/handbook.asp?level=EE101

9.2

The game is drawn, upon a correct claim by the player having the move, when
the same position, for at least the third time (not necessarily by a
repetition of moves)

1.

is about to appear, if he first writes his move on his scoresheet and
declares to the arbiter his intention to make this move, or
2.

has just appeared, and the player claiming the draw has the move.

Positions as in (a) and (b) are considered the same, if the same player has
the move, pieces of the same kind and colour occupy the same squares, and
the possible moves of all the pieces of both players are the same.
Positions are not the same if a pawn that could have been captured en
passant can no longer in this manner be captured or if the right to castle
has been changed temporarily or permanently.

Correct, since it's not the same position.

Sounds like a system flaw.

Must be. It is only a draw if one person claims it.
In this case nobody claimed the draw.

Perhaps the opponent claimed the draw. (As we all agree, it shouldn't
have been granted in any case.)

On Playchess.com the draw does not have to be claimed for
repetition or the 50 move rule. It is given automastically.

Thanks for the confirmation.

Yeah, I guess so.
