I have filed a lawsuit against Truong, Polgar, USCF et al

The case has been filed in the United States District Court for the
Southern District of New York at 500 Pearl Street, New York NY 10007.

The case number is 07 CIV 8537

The judge is Judge Denny Chin

The Magistrate Judge is Judge Frank Maas

The suit seeks to overturn the results of the 2007 USCF Election on
the grounds of election fraud and to reinstate the directors who were
thrown out in that election until a new election can be held. The
complaint alleges that defendants Susan Polgar and Paul Truong
impersonated Sam Sloan and sent out three thousand obscene and
pornographic newsgroup postings during the election campaign in order
to discredit Sloan and get themselves elected so as to take over the
USCF Finances.

The answer is the same as I answered in other threads that raise this
subject. We (the USCF Executive Board) are going to remain deliberate
and deliberative in our actions. We have a course of action, but this
isn't speed chess. Doing it right is more important than doing it
quick.

I have yet to see a report from these other so-called experts. Until
I see something in writing putting their reputation (and perhaps their
financial well-being) on the line, it's all just assertion.

The First Mottershead report came out on September 26, 2007. We then
learned that he had already communicated his findings privately to
Bill Goichberg and Bill Hall one week earlier. Then Mottershead was
told to make a more complete report, which he did in a record time of
only about one week. Meanwhile, I had filed my lawsuit.

Then, you were not willing to accept the Mottershead Report that you
had asked him to do, so you said that you were going to retain an
independent expert to review his findings.

That was nearly one month ago. Now we learn that you have not retained
the independent expert yet. You state, "we are going to remain
deliberate and deliberative in our actions."

But you only have until November 20 to file a responsive pleading to
my lawsuit. How much longer are you going to "deliberate" before
doing anything?

Can anyone cite an example of a case so extreme as this one?

I have not had a chance to research Illinois law but I have researched
Delaware law because of a prior situation that came up and because I
wrote a book about it entitled "How To Take Over a Publicly Held
Corporation" and I can tell you that there have been many times when
the Delaware Courts have overturned an election or have removed
elected members of a board and Delaware is considered to be the most
pro-management state there is.

Sam, you can't go far with this lawsuit.

You file litigation like this, and you need to demand trial by jury.
You are weak and that the complaint never demands a jury trial. A
judge will toss the case. You look at any litigation that rambles off
27 pages of facts, cites no legal foundations, asks for no jury, and
it is difficult for me to see much happening.

I mean, the suit has merit. However, the lawsuit will probably be
dismissed. Now, Sam, if you demanded trial by jury, on the other hand,
you might get a jury.

I suggest you amdned your complaint, do as Ray says, demand trial by
jury, and

I have just filed an ethics complaint, with the 25 dollars enclosed,
against

Glen Peterson, former Editor of Chess Life and Daniel Miller

tracking number EB 480775604 US.

The ethics complaint shows a clear copy of a Cherry Hill, NJ police
report demonstrating a conspiracy (the act of more than one person) to
keep me out of the Delegate's meeting certifying the election. That
is, the Delegates never properly were assembled, because I was not
present to challenge the slate of delegates. Therefore, Mr. Sloan is
correct in (some) of his legal arguments. The election was not proper,
and should be declared NULL and VOID.

Does anyone know if the ethics committee of the USCF has liability
insurance for libel slander?

I want to hear the USCF side of this story before I sue some of the
same people Sloan is suing. After all, Peterson could be expelled.

I support Sloan's suit, and will swear out any necessary documentation
to that effect.

2) didn't list a street address for service for the USCF; and 3) why you
said you didn't believe someone was a lesibian now, and yet before you said
you did (were you wrong then or now?); and 4) didn't include a statement of
jurisidiction and venue?
